Terms of Service
I. General provisions
1. The hereby Terms of Service shall specify the rules and conditions of the services related to visa assistance services available on the website https://canada-evisa.com/ (further: "canada-evisa.com").
2. WIKKA Sp. z o.o. with its registered office at ul. Wandy 66/43, 43-600 Jaworzno, Poland entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for Katowice – Wschód, VIII Commercial Division of the National Court Register under KRS number 0001013771, NIP (Tax Identification Number): 6322033250, REGON number: 524199020, hereinafter referred to as the WIKKA, is the owner of canada-evisa.com.

4. Terms of Service available on canada-evisa.com as well as the Privacy Notice are available free of charge on the internet website https://canada-evisa.com/ in such a way so as to enable familiarising with the contents, obtaining, accessing and recording them. This documents may be also obtained at the headquarters of WIKKA with its registered seat in Kraków.
5. Terms of Service govern the provision of all and any services provided by WIKKA on canada-evisa.com in respect of but not limited to the obtaining of visas and/or other documents for their clients and all orders placed by their clients are made accepted subject to the terms hereinafter set out.
6. Technical requirements necessary to use WIKKA services available at canada-evisa.com:
a) a device with access to the Internet.
b) Internet browser like Internet Explorer, version 8.0 or higher, Mozilla Firefox version 3.6 or higher, or similar browser installed on the device, and Java Virtual Machine installed.
c) Acrobat Reader or other software that supports PDF files installed on the device.
II. Definitions
Below terms ought to be understood in Terms of Service as:
a) Visa – written authorization to cross the border and stay in the territory of a foreign State issued to foreigners by the diplomatic or consular representations (Consular Departments, General Consulates) of that State. About the necessity of requiring a visa by a State decides individual international agreements between specific countries or international organizations (e.g. European Union) and it has a variable character (it is not determined "once and for all").
b) Client – an adult person, being a Consumer, who concludes a service agreement with the WIKKA and who has accepted the Terms of Service.
c) Consumer – shall be deemed to be any natural person who performs acts in law with an entrepreneur, said acts not being directly connected with his economic or professional activity.
d) Terms of Service – the hereby Terms of Service defining principles and conditions of services provided by WIKKA on canada-evisa.com.
e) Agreement – an Agreement between Client and WIKKA which establishes mutual rights and obligations specified in the Terms of Service. It is considered that the Agreement containing the provisions of the hereby Terms of Service shall be automatically concluded at the time of fulfilment of conditions specified in clause IV.1
III. Types and scope of services provided
1. WIKKA provides visa assistance services whose current scope is available at canada-evisa.com.
2. In case of services related to Canada it includes assistance in obtaining:
a) Electronic Travel Authorization (eTA)
IV. Conclusion of an agreement
Our service is as an online application service provider used to facilitate the Electronic Travel Authorisation. The services provided here concern the reviewing and sending of application for eTA. The cost of processing requests includes the service fee, the amount of which depends on where the application is made. The processing fee includes CAD$ 7 to the Canadian government for the issuance of your eTA. We are not affiliated with the Canadian government or embassy. You can apply directly via https://www.canada.ca.
1. An agreement with the Client regarding the provision of visa assistance services is concluded provided that the following conditions are met:
a) the Client submits the order correctly. The order can be placed online by completing and sending the Form, available on the canada-evisa.com, (https://canada-evisa.com)
b) WIKKA confirms the receipt of the order and provision of the services ordered by the Client,
c) the Client pays the whole amount of WIKKA’s service fee.
2. If the Client provides incorrect contact details, including a telephone or e-mail address and as a consequence WIKKA will not be able to contact the Client, the abovementioned confirmation or visa shall be deemed delivered if it has been sent to the address provided by the Client.
3. WIKKA may contact the Client to verify his personal data.
4. As a rule the maximum time to obtain a visa electronically by email is 72 hours following the execution of payments.
V. General terms of use of visa assistance services
1. The visa assistance service is provided on the basis of the Client's order. By placing an order the Client shall grant WIKKA necessary power of attorney to use the submitted documents to the extent necessary to perform the service.
2. Visa assistance services are provided using the Canadian government website https://www.canada.ca
3. By placing an order, the Client is obliged to submit all relevant documents necessary to perform visa assistance services and provide contact address and telephone number.
4. Information about the necessary documents is available on canada-evisa.com and may be provided via e-mail or telephone.
5. The Client is obliged to grant WIKKA all the necessary powers of attorney to perform the ordered services.
6. It is forbidden to submit documents obtained in violation of the law. The Client declares, that he is entitled to transfer to the WIKKA all submitted documents.
7. The WIKKA reserves the right to request additional documents in case of inquiries from the visa entities (like consulates, embassies, passport offices).
8. The WIKKA reserves the right to suspend/denial the execution of the order if the documents received from the Client raised doubts as to their authenticity or compliance with the relevant regulations. The WIKKA shall immediately notify the Client about the suspension of activities for this reason.
9. The visa is issued in electronic form, assigned to the passport indicated during the reservation. The visa is delivered to the specified e-mail address during the reservation process.
VI. Payment methods
1. Payment for services offered by WIKKA may be conducted through:
a) Dotpay - online payments
b) Bank transfer (online or wire transfer)
c) Payment card (debit and credit cards are accepted)
d) BLIK (payment with code from your bank’s app)
e) Digital wallets (Visa Checkout, Masterpass)

2. All payments are transferred to the account of WIKKA.
3. The WIKKA will send a VAT invoice via electronic means (PDF file) to the email address from which the Client contacted the WIKKA. In particularly justified cases the WIKKA may send a VAT invoice to another email address, indicated by the Client. By purchasing and accepting the Terms of Service - The Client agrees to receive VAT invoice via electronic means.
VII. Responsibility
1. WIKKA does not guarantee a successful outcome of the visa assistance services, or its performance in the set deadline. WIKKA’s due diligence obligations are of conduct rather than result, meaning that WIKKA deploy its best efforts to achieve a desired outcome, even if that outcome need not be ensured.
2. WIKKA has no control over the decisions made by issuing authorities regarding denial or approval of any visa or travel document. The issuance of a visa is entirely at the discretion of the issuing authority. Thus, WIKKA does not guarantee the issuance of any document. Further, WIKKA is not responsible for the failure of any issuing authority to issue a visa, or other travel document in a timely fashion for reasons beyond the control of WIKKA.
3. WIKKA will use its best endeavours to process applications for visas, and/or documents at the client’s request. However, WIKKA shall not be held responsible nor accept any liability for its own actions or those of any consulate, embassy, passport office or subcontracted couriers, servants or agents in delaying or not issuing such applications for any reason whatsoever, nor shall WIKKA be held responsible for expense and /or delay arising from or in connection with (a) incomplete application forms or (b) incorrectly or falsely completed application forms or (c) inaccurate or incomplete supporting documentation. Any expense or cost incurred by the client due to these delays or non-issuances shall not be the responsibility of, nor shall any charges be levied upon WIKKA. Tickets for travel should not be purchased prior to the visa being issued unless they are a specific requirement for that consulate and in such cases open tickets should be obtained.
VIII. Complaints
1. The Client may lodge a complaint regarding the services provided by the WIKKA. The recommended term for submission of complaints is within 14 days from the date of the event which caused the complaint.
2. All complaints concerning the services provided on the basis of this Terms of Service may be submitted:
a. via electronic means to the email address: info@canada-evisa.com,
b. via post to the address of the WIKKA, specified in clause I.3
c. in person at the headquarters of the WIKKA.
3. The complaint should contain at least the name, surname and e-mail address as well as the description of event which caused the complaint.
4. If data contained within the complaint require supplementation, the WIKKA requests that the complaining person supplements the complaint within the indicated scope prior to reviewing the complaint.
5. The complaints which do not contain data such as: name, surname, e-mail address, which would allow for an identification of the Client will not be considered by the WIKKA.
6. The WIKKA shall process a complaint within 14 days from the date of obtaining it or its supplementation, and in case of matters of more complicated nature, this period may take up to 30 days. In case of the necessity to supplement the complaint the term for reviewing the complaint commences on the day of receipt of documents by the WIKKA which supplement the complaint or which provide additional explanations/information. In case of an inability to meet the deadline for the review of a complaint, the WIKKA will inform the Client of any delays, indicating the cause of a delay (circumstances which must be established) and an expected term for the review of the complaint.
7. Response to a complaint shall be posted to the Client via electronic post or traditional post to the correspondence address in a manner specified in the complaint. The WIKKA may send the response to an alternative address/ email address indicated for correspondence by the Client who submits a given complaint.
8. The consideration of a complaint consists of an identification of the problem, assessment of its justification and settlement of the problem submitted by the Client or a conduct of adequate actions in order to remove any potential irregularities, causes of their occurrence and to grant a thorough, and professional in form and in content reply.
9. WIKKA issues a reply which includes its position of the regarding the complaint, its justification and the information regarding the appeal procedure.
10. The Client has the right to appeal against the decision issued by the WIKKA. The appeals ought to be sent regardless of the method of submission-letter, email- no later than within 14 days from receipt of the decision by the Client which he wishes to appeal against. The appeal will be considered within 14 days from the day of its submission.
11. Regardless of the complaint procedures the Client may launch civil action in the adequate court.
IX. Withdrawal from the agreement
1. The Client may withdraw from the Agreement concluded with the WIKKA on the basis of the provisions of law, without indicating the cause, within the term of 14 days from the date of its conclusion. The term is considered as fulfilled if prior to its expiry the Client posts a statement of withdrawal from Agreement.
2. The Client may withdraw from the Agreement via:
a. sending to the WIKKA's email address info@canada-evisa.com statement regarding withdrawal from Agreement;
b. sending to the postal address of the WIKKA, specified in clause I.3 a written declaration of withdrawal from Agreement. For this reason the Client may avail of the form on withdrawal from Agreement enclosed in Annex no. 2 to the Act on consumer rights (Journal of Laws of 2017, item 683), however, this is not obligatory.
3. In case of withdrawal from the Agreement, the Agreement is treated as non-concluded. In case of withdrawal from the Agreement each party is obliged to return to the other party all the items it obtained on the basis of the Agreement. The return of the services occurs no later than within 14 days from the day of receipt by the WIKKA of the declaration regarding withdrawal from the Agreement. The return of payment is conducted with the use of the same payment methods which were used by the Client in the initial transaction, unless within the declaration of withdrawal from the Agreement the Client agreed to another solution. Another solution ought to be indicated by the Client within the submitted declaration.
4. Should, pursuant to the demand by the Client, the execution of service commence prior to the expiry of the term of withdrawal from Agreement, the Client is obliged to pay for the services fulfilled until the moment of withdrawal from Agreement. The return of the funds remaining on the account occurs no later than within 14 days from the day of receipt by the WIKKA of the declaration regarding withdrawal from the Agreement with the use of the same methods of payment which were used by the Client in the initial transaction, unless the Client indicated an alternative solution within declaration regarding withdrawal from Agreement.
X. Personal data protection and privacy notice
1. Personal data are processed by WIKKA as administrator in accordance with requirements of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and Privacy Notice.
2. Privacy Notice is available on the website https://canada-evisa.com/
XI. Final provisions
1. Conclusion of the agreement constitutes acceptance of these Terms of Service.
2. The WIKKA reserves the right to change the Terms of Service or Privacy Notice due to important reasons, that is to adapt the Terms of Service to the solutions provided by the law or when a change is necessary due to a decision made by a court or other competent public authority body or in order to implement new technical means to protect privacy or when it is necessary due to technical reasons connected with the provision of services for the user or when such a necessity stems from the changes in the scope of the services offered via canada-evisa.com.
3. The WIKKA shall notify the users of any changes to the Terms of Service or Privacy Notice via the canada-evisa.com.
4. All and any changes to the Terms of Service or Privacy Notice shall become valid on the date and time indicated in their new version, and if no such information is provided, from the moment of making the updated Terms of Service available on the canada-evisa.com, provided by WIKKA.
5. For all matters unresolved in the hereby Terms of Service the binding in Poland legal provisions shall apply, and in particular, the provisions of the Civil Code.
6. In case of any discrepancies between the Polish and foreign language version of the Terms of Service, the Polish version of the document shall prevail.
